Background

The purpose of the EU Environmental Liability Directive (ELD) is ‘to establish a framework of environmental liability based on the “polluter pays” principle, to prevent and remedy environmental damage’.

The underlying intent in the framework of environmental liability established by the ELD is to induce operators to adopt measures and develop practices to minimise their operations that cause environmental damage in order to avoid exposure to the financial liabilities of remedying the damage and preventing further damage.

Objectives

The general objective of this project is to carry out a study of the ELD in order to support the Commission’s evaluation of it by 30 April 2023 by providing the Commission with necessary evidence and analysis and an assessment of the effectiveness of the effectiveness, efficiency, relevance, coherence and EU added-value of the ELD.

The specific objectives are to:

  1. Document the status of implementation of the ELD in Member States;
  2. Provide evidence to underpin the Commission’s evaluation;
  3. Undertake various consultation activities
